Man living with ex-wife fights her over family home when he remarries

A Singaporean man and his ex-wife, who divorced in 2005, had continued living together in their matrimonial home for 18 years, as per their divorce agreement. The arrangement was that the property would be sold after their youngest child turned 21, with proceeds divided equally. The ex-wife received $2 million under the arrangement. However, complications arose when the man remarried in 2022 and sought to sell the house, leading to a dispute with his ex-wife.​TNP

It will be another 7 years before the youngest turn 21. Meanwhile the man and his ex-wife’s CPF were reduced to almost nothing as the man’s business had failed. The court had to consider whether the ex-wife has to bear half of the monthly mortgage instalments for the next 7 years until the property could be sold.

The court found in favour of the husband and ordered that the ex-wife be equally responsible to pay the mortgage instalments. However, the court ordered that the husband will only be able to recoup her half share of the mortgage instalments when the property is sold 7 years later. Nevertheless, the court enjoined the ex-wife to pay her half share to prevent the bank repossessing the property.
